Supremes say Amendment 5 is "Misleading"

The Florida Supreme Court has ruled that Amendment 5 will not be on the November ballot.  It is the position of the state's highest court that amendments to the Constitution must be clear, unambiguous and not misleading.  The court found that the property tax scheme implemented by the amendment was not clear in its intended effect.

Neither myself, nor the court, is not concerned that this decision will mark the end of democracy as we know it.  Instead, the court is aware that people's right to vote and change government/laws only applies when they are voting on amendments that make sense.

Take a clue dude.  The CTLAC summaries were nowhere near as jacked up as amendment 5.  I made a comment on it several blogs back saying it looked intentionally deceptive.  No matter what any of us think, Buttner will make a judgement very soon.

Byron,

More news out of the Capitol this morning.  From Florida Capitol News, 09.04.08, the Fl. Supreme Court also axed Amendments 7 & 9, dealing with education policy & school vouchers.  It's a start, but I doubt that Jeb Bush & his crowd will leave this alone.  I have to wonder what improvements could be made to the many problems of the public school system, if people like Jeb would use their energy in fixing the original problems, rather than attempting to use public funds for private &/or religious schools, something the Supreme Court has already judged as unconstitutional?  NAH.  I guess that just makes too much sense for people like him.  JATFUR.

Felix, you stated Buttner would make a judgment soon.   Are you referring to the Lyons vs CTLAC, et al case?

If so, which party filed the motion for Summary Judgment?

I read about these ammendments being axed. I would really like to understand them all a little better. To that end I planned on attending the meeting tonight at the Fleming Island library at 7 PM. Now I see they are not going to be on teh ballot.

So, will there be an explanatory meeting on the Florida ammendments ot not? Anyone?

Lily,

From what I understand from Pym's original blog, they will be covering all the proposed issues.  And the marriage ban amendment is still active.  I still plan on going.
