A question for readers....
Can anyone tell me if it is legal or illegal for a person to buy several homes, in a single home, deed restricted neighborhood, and then rent them as multi-family dwellings? This is happening in my 'hood; in fact, one of the houses is next door to mine. Just wondering. Thanks. Marsha - I'm told by the PM, they can't control what goes on INSIDE of a house. Personally, I think that cannot be right. But, I'll be contacting the zoning board. The person who has purchased the houses (and who lives in one) is renting the others out to several families at the same time. The past year, in addition to having rented to a couple with a child, there was a family of 4 living in the master suite of the house. She claims the living & kitchens areas as "common areas". The information below may help you talk to the Clay County officials in regard to your question. I would also read the Declaration of Conditions, Covenants, Restrictions and Easements in reference to where you live. You may find them on the website for the Clay County Clerk of the Circuit Court. Look under “Official Records”, the Document Type would be RE. Put in the name of your subdivision. PART ONE. ALL SUBDIVISIONS* Dwelling, multi-family. A building containing three (3) or more dwelling units. Dwelling, single-family. A building containing only one (1) dwelling unit. Dwelling, two-family or duplex. A building containing only two (2) dwelling units. Dwelling unit. A building or portion of a building consisting of one (1) or more rooms which are arranged, designed, or used as living quarters for one (1) family only, containing independent sanitation and cooking facilities (one (1) kitchen only). Family. Two (2) or more persons, of which each one shall be related to at least one (1) household occupant by blood kinship, however remote, or marriage. Planned unit development project (PUD). An organized comprehensive program for flexible planning approval of improvements on a parcel of land in compliance with basic and specific development of objectives and regulations, allowing individualized land use and site plans. All PUDs are required to have comprehensive development plans prior to approval, in accordance with the requirements of this ordinance. Restrictive covenants. Private regulations recorded with the final plat which limit or otherwise govern the use, intensity, and development patterns of land within a subdivision or parcel of land for a specified time. Subdivision. The division of a lot of record as of October 1, 1985, whether or not improved, into six (6) or more lots or parcels of land, more than five (5) of which are less than ten (10) acres in area each by conveyance, regardless of whether made by reference to any plat, a map, or survey or not. The term includes a re-subdivision and when appropriate to the context, relates to the process of subdividing, whereby the term "subdivide" means any act which results in the subdivision of land as defined herein, or to the land subdivided. The definition also includes metes and bounds descriptions of lots of record whether designated by reference to the number or symbol of the lot or parcel, and is intended to apply solely to single-family detached and two-or three-family attached housing developments. The question as to whether or not that is allowed MeMaw would be in the Covenants for your community. The quickest way would probably be to contact the Property Mgmt Company for your Homeowners Association, or a board member of your association. I rather doubt there are any rules about renting out one home, but there could be something in there about multiple investment homes.
